By downloading, installing, or using Paint Pals ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use our App.

Age Requirements

• Paint Pals is available to users of all ages
• Users under 13 must have parental consent to create an account
• Users between 13-18 should review these Terms with a parent or guardian

2. Your Account

Account Creation

To access certain features, you may need to create an account. When you do:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• You're responsible for all activity under your account

Account Types

• Free Account: Access to basic features and limited cloud storage
• Premium Account: Unlimited storage, exclusive brushes, and priority support
• Family Account: Multiple user profiles with parental controls

3. Acceptable Use

Paint Pals is designed to be a positive, creative space. You agree NOT to:

Prohibited Activities

• Create or share inappropriate, offensive, or harmful content
• Harass, bully, or intimidate other users
• Impersonate others or misrepresent your identity
• Use the App for any illegal purposes
• Attempt to hack, reverse engineer, or damage the App
• Violate any third-party rights, including copyright and privacy
• Use automated systems or bots without permission
• Spam or send unsolicited messages to other users

4. Content & Ownership

Your Content

You retain ownership of the artwork you create in Paint Pals. By using the App, you grant us:

• A license to store, display, and sync your content across your devices
• Permission to use anonymized artwork data to improve our AI features
• The right to showcase publicly shared artwork in our gallery or promotions (with attribution)

Our Content

Paint Pals and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

User-Generated Content Guidelines

When sharing artwork publicly, you confirm that:

• The content is your original creation or you have permission to share it
• It doesn't violate any third-party rights
• It's appropriate for all ages
• You accept that other users may view and be inspired by your public artwork

5. AI Features

AI Art Generation

Our AI-powered features are provided "as-is" with the following understanding:

• AI-generated content may not always meet your expectations
• We don't guarantee the uniqueness of AI-generated artwork
• AI features may be updated or modified over time
• You're responsible for reviewing AI-generated content before sharing

6. Multiplayer Guidelines

Collaborative Drawing

When using multiplayer features:

• Respect other users' contributions to shared canvases
• Follow our community guidelines for appropriate content
• Don't share personal information with strangers
• Report any inappropriate behavior immediately

Parental Controls

Parents can:

• Restrict multiplayer access for child accounts
• Approve friend requests
• Monitor drawing sessions
• Set time limits for app usage

7. Purchases & Subscriptions

In-App Purchases

• All purchases are processed through the Apple App Store
• Prices may vary by region and are subject to change
• Virtual items (brushes, colors, templates) are non-transferable

Premium Subscriptions

• Subscriptions auto-renew unless cancelled 24 hours before the renewal date
• Manage subscriptions through your App Store account settings
• No refunds for partial subscription periods
• Free trials convert to paid subscriptions unless cancelled

Refund Policy

Refunds are handled according to Apple's App Store policies. For subscription issues, contact our support team for assistance.

8. Termination

Your Rights

You can stop using Paint Pals and delete your account at any time through the app settings.

Our Rights

We may suspend or terminate your account if:

• You violate these Terms or our Community Guidelines
• Your account is inactive for an extended period (12+ months)
• Required by law or court order
• We discontinue the service

Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• We may delete your account data after 30 days
• You can export your artwork before account deletion
• Provisions that should survive termination will remain in effect

9. Disclaimers & Limitations

Service Availability

Paint Pals is provided "as is" and "as available." We don't guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected immediately
• The App is free of viruses or harmful components
• Results will meet your specific requirements

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from your use of Paint Pals or violation of these Terms.

10. General Provisions

Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes through:

• In-app notifications
• Email (if you've opted in)
• App Store update notes

Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association rules.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Paint Pals.
